General Terms and Conditions for the Booking of Travel Services
Individual travellers (direct bookings)
1. General Conditions
These General Conditions govern the booking and provision of the travel services marketed by SAK Wine & Travel EVT, Licence No. 14.434, Resolution No. 241/2010 (hereinafter, “SAK Wine & Travel” or “the Company”), and apply to all services booked by its clients.
Booking any of the services offered by the Company implies the full, express and unreserved acceptance of these General Conditions by the Client.
These General Conditions govern exclusively the relationship between SAK Wine & Travel and the individual traveller who books services for themselves, their family or their travel companions, acting as an end consumer. Bookings made by travel agencies, tour operators, companies or any other intermediary that resells or markets the services are governed by the separate B2B commercial and rate agreements entered into with them, which prevail over this document.
2. Governing Law and Jurisdiction
The contractual relationship between SAK Wine & Travel and the Client shall be governed by the laws in force in the Argentine Republic, including Law No. 19.918, which ratifies the International Convention on Travel Contracts, the National Travel Agencies Law No. 18.829, its implementing regulations and any other applicable legislation.
Any judicial matter arising from the interpretation, performance or fulfilment of this contract shall fall under the jurisdiction of the courts designated by the laws in force in the Argentine Republic.
3. Quotations and Rates
All quotations issued by SAK Wine & Travel are estimates and are subject to availability and confirmation at the time the booking is made.
Rates may change without prior notice until the booking has been confirmed in accordance with the conditions set out in this document.
Where a service is quoted in United States dollars (USD), the applicable exchange rate shall be the official selling rate published by Banco de la Nación Argentina in force on the day payment is made.
Should rates change before the booking is definitively confirmed, SAK Wine & Travel will inform the Client of the variation, and the Client may either accept the new quotation or withdraw from the booking before final confirmation.

Business hours: Monday to Friday, 9:00 a.m. to 5:00 p.m.
5. Formation of the Contract
The contract between SAK Wine & Travel and the Client shall be formally entered into once the Agency simultaneously receives:
- The Booking Form or the information required to complete the booking, duly filled in.
- Payment of the corresponding deposit, which may not be less than fifty per cent (50%) of the total value of the services booked, unless the Company sets a different percentage due to the particular conditions of the service.
From that moment, both parties shall be bound by these General Conditions.
Where a booking includes more than one traveller, the person making the booking declares that they act with sufficient authority to represent all individuals included in it, and confirms that all of them are aware of and fully accept these General Conditions.
Confirmation of the booking is subject to the actual availability of the services booked and, where applicable, to final acceptance by the respective suppliers.
6. Air and Ground Transport
Where SAK Wine & Travel arranges air, ground, sea or rail transport services on behalf of the Client, it acts solely as an intermediary between the Client and the transport companies.
Accordingly, the provision of such services shall be governed by the conditions established by each carrier, which are solely responsible for performing the service, including, among others, schedule changes, delays, cancellations, rescheduling, overbooking, lost or delayed baggage, strikes, technical faults or any other circumstance inherent to their operation.
SAK Wine & Travel shall not be liable for any damages, expenses or losses arising from events attributable to the transport companies.
In the case of air tickets, once the corresponding deposit has been paid the Agency may hold the flight reservation; however, tickets will only be issued once their full amount has been paid, unless expressly agreed otherwise.
The Client acknowledges that airfares are dynamic and may vary until the moment of issue, and is responsible for any fare difference that may arise.
7. Payment Terms
To confirm any booking, payment of a deposit of at least fifty per cent (50%) of the total value of the services booked is mandatory, unless SAK Wine & Travel requests a higher percentage due to the particular characteristics of the service or to supplier requirements.
The outstanding balance must be paid at least fifteen (15) calendar days before the service start date, unless a different deadline is communicated at the time of booking.
Failure to pay within the established deadlines entitles SAK Wine & Travel to cancel the booking, applying the penalties and expenses set out in these General Conditions and in the policies of the suppliers involved.
8. Payment Methods and Payment Terms
Payment methods
SAK Wine & Travel accepts the following payment methods:
- Bank transfers (for travellers within the domestic market).
- Credit and debit cards through the platforms enabled by the Agency, such as Payway and Getnet.
- Authorised digital wallets, including Mercado Pago, MODO and PayPal, subject to availability and the Client’s country of origin. A 10% surcharge applies to payments made through these wallets.
The Agency may add, modify or remove payment methods without prior notice.
Payment terms
Services may be paid under the following arrangements:
- Advance payment: payment made before the service is provided. To confirm a booking, payment of the deposit established by the Agency is mandatory.
- Instalment payment: subject to the commercial conditions in force, the availability of the payment platforms and any applicable financing costs.
9. Changes to Services by SAK Wine & Travel
SAK Wine & Travel will use its best efforts to provide the services booked in accordance with the confirmed itinerary.
However, the Client acknowledges that certain travel services depend on third parties and on circumstances beyond the Agency’s control, and that changes may therefore occur before or during the provision of the service.
In such cases, SAK Wine & Travel may partially or wholly modify the itinerary, timings, order of activities, transport, accommodation, suppliers or any other service included in the booking, replacing them with others of a similar category and characteristics, where this is necessary to ensure the continuity of the trip or for operational, safety or force majeure reasons.
Where a change is considered substantial and is not due to force majeure, the Agency will inform the Client as soon as possible.
The Client may choose to:
a) Accept the proposed changes.
b) Request a change to other available services, paying or receiving any applicable price difference.
c) Cancel the booking, subject to the particular conditions of the case and to any costs actually incurred with third parties.
10. Cancellations by SAK Wine & Travel
SAK Wine & Travel may cancel a booking in whole or in part where circumstances beyond its control prevent the proper provision of the service.
These include, by way of example and without limitation:
- Adverse weather conditions.
- Risks to the safety of travellers or staff.
- Instructions issued by the competent authorities.
- Failure to reach the minimum number of participants, where applicable.
- Acts of God or force majeure.
- Breaches by the Client that make it impossible to provide the service.
Where the cancellation is attributable solely to the Client or arises from an event of force majeure, the Agency shall not be obliged to refund professional fees or any amounts already paid to third parties that are non-refundable.
Each situation will be assessed in accordance with the particular conditions of the service booked and the policies of the suppliers involved.
11. Changes Requested by the Client
Any request to modify a confirmed booking must be sent in writing to SAK Wine & Travel by email or by any other verifiable means enabled by the Agency.
Change requests are subject to the availability of the suppliers of the services booked and cannot be guaranteed.
Changes may include, among others, changes to dates, timings, itineraries, accommodation, excursions, number of travellers or other services originally booked.
All expenses, fare differences, penalties or administrative charges arising from such changes shall be borne exclusively by the Client.
Acceptance of a change request by SAK Wine & Travel shall not imply a waiver of the conditions originally agreed or of any applicable penalties.
12. Cancellations Requested by the Client
The Client may cancel all or part of the services booked at any time, and must communicate this decision in writing to SAK Wine & Travel by email or by any other verifiable means enabled by the Agency.
The date on which this communication is received shall determine the cancellation charges to be applied.
Unless particular conditions were communicated at the time of booking or specific supplier policies apply, the following cancellation charges shall apply:

The percentages indicated are minimum charges and may increase where service suppliers (hotels, airlines, transport companies, wineries, tour operators or others) apply higher penalties or non-refundable rates.
Partial cancellations will be assessed individually and may give rise to fare differences, administrative expenses or additional charges, which will be communicated to the Client and borne exclusively by them.
Where SAK Wine & Travel has made advance payments to suppliers that are not recoverable, such amounts cannot be refunded to the Client.
13. Force Majeure and Acts of God
SAK Wine & Travel shall not be liable for the total or partial inability to provide the services booked where this is due to unforeseeable or unavoidable circumstances beyond its control.
For the purposes of these General Conditions, an act of God or force majeure means any extraordinary event that prevents or hinders the normal performance of the services, including, by way of example only:
- wars, armed conflicts or threats of war;
- acts of terrorism, civil unrest or violent demonstrations;
- strikes, blockades or labour disputes;
- epidemics, pandemics or health emergencies;
- fires, floods, earthquakes or other natural disasters;
- adverse weather conditions;
- government measures;
- border closures;
- flight cancellations or rescheduling;
- technical failures of means of transport;
- decisions taken by airlines, hotels or any other supplier involved in the provision of the services.
In any of these events, SAK Wine & Travel may modify, reschedule, suspend or cancel the services booked in whole or in part, seeking to offer reasonable alternatives where possible.
The Agency shall not be liable for additional expenses, losses or damages caused by such circumstances, without prejudice to its efforts to obtain from the relevant suppliers any refunds or credits that may apply.
14. Documentation, Visas and Health Requirements
It is the Client’s sole responsibility to hold, at the time of travel, all documentation required to enter, remain in and travel through the destinations booked.
Among others, the Client must check the validity of:
- National identity document.
- Passport.
- Visas.
- Travel authorisations for minors.
- Vaccination certificates.
- Health requirements imposed by the competent authorities.
- Any other documentation required by the destination country or by the transport companies.
SAK Wine & Travel may provide guidance; however, such information does not replace the Client’s obligation to personally verify the requirements in force at the time of travel.
The Agency shall not be liable for the inability to travel, or for delays, losses or expenses arising from incomplete, expired, incorrect or insufficient documentation.
Should the Client have to interrupt, cancel or abandon the trip due to failure to meet these requirements, they shall not be entitled to any refund, without prejudice to any rights they may exercise against third parties.
Travellers under eighteen (18) years of age must comply with all authorisations and requirements established by the legislation in force for travel within or outside the national territory.
15. Health Status and Special Conditions
When booking any of the services offered by SAK Wine & Travel, the Client must inform the Agency of any illness, disability, allergy, particular medical condition or any other circumstance that may require special assistance during the trip or affect the normal provision of the services booked.
It is the Client’s sole responsibility to travel in physical and mental condition compatible with the activity booked, and to carry the medication, treatments, medical certificates and any other items they may need during the trip.
Failure to disclose relevant information may prevent the proper provision of the service and, where this compromises the safety of the Client, of other travellers or of the staff involved, SAK Wine & Travel may restrict or refuse their participation in certain activities, without this giving rise to any right to a refund.
16. Insurance
Medical insurance
Unless expressly stated in the booking confirmation, the services booked do not include traveller medical assistance or travel assistance insurance.
SAK Wine & Travel recommends that all Clients take out travel assistance insurance appropriate to the destination and to the activities they will undertake.
Personal Accident Insurance
Where a service includes Personal Accident Insurance, such cover shall be the policy taken out with the relevant insurance company and shall be subject to the general and particular conditions, exclusions, limits and amounts set out in the policy in force.
Where applicable, cover may include, among other benefits:
- Accidental death.
- Total or partial permanent disability.
- Medical and pharmaceutical assistance arising from accidents.
- First aid.
- Emergency transfers.
- Funeral expenses, where covered by the policy.
Cover shall only be valid where the service has been duly notified to the insurer within the deadlines and conditions established by the policy taken out.
SAK Wine & Travel acts solely as policyholder or intermediary of the insurance where applicable, and is not responsible for the acceptance, rejection or scope of the cover provided by the insurance company.
17. Liability of SAK Wine & Travel
SAK Wine & Travel operates as a Travel and Tourism Company duly licensed under the legislation in force in the Argentine Republic.
The Agency acts as organiser and/or intermediary between the Client and the various travel service suppliers, such as airlines, transport companies, hotels, wineries, restaurants, guides, tour operators and other suppliers involved in the trip.
Accordingly, the liability of SAK Wine & Travel is limited to the proper organisation, coordination and intermediation of the services booked, and it shall not be liable for breaches, changes, delays, cancellations, damages, losses, injuries, accidents, omissions or any other event attributable to such suppliers or to circumstances beyond its control.
Likewise, the Agency shall not be liable for loss of baggage, personal belongings, documentation, money, valuables or personal effects of travellers during the trip.
The Client assumes liability for any damage that they, or any member of their group, cause to third parties, other travellers, staff, suppliers or public or private property during the provision of the services.
SAK Wine & Travel undertakes to act with the diligence proper to its activity, seeking to provide the services booked in accordance with the confirmed itineraries and taking the measures reasonably necessary to minimise any inconvenience that may arise during their performance.
18. Communications
All communications relating to bookings, changes, cancellations or any other matter connected with the services booked must be made in writing through the official channels of SAK Wine & Travel.
The Agency may treat as valid any communication made by email, WhatsApp or other enabled electronic means, provided that these allow the sender to be identified and a record of the communication to be kept.
19. Personal Data Protection
The personal data provided by the Client will be used exclusively to manage bookings, provide the services booked and comply with the corresponding legal obligations.
SAK Wine & Travel undertakes to treat such information confidentially and in accordance with the personal data protection legislation in force.
20. Acceptance of the General Conditions
Booking any of the services offered by SAK Wine & Travel, whether in person or through electronic means, including email, WhatsApp or other official channels, implies that the Client has read, understood and fully accepted these General Conditions.
Any matter not expressly provided for in this document shall be governed by the legislation in force in the Argentine Republic and by the particular conditions of each service booked.
